Public offer for services

orgculture.ru · version of 26.10.2026

1. General provisions

1.1. This public offer (the “Offer”) is a proposal by Konstantin Alekseevich Moshnikov, self-employed (professional income tax payer), INN 471508674254 (the “Contractor”), to enter into a paid services agreement on the terms below with any person (the “Client”). The Russian version prevails in case of discrepancy.

1.2. The Offer is accepted by paying for a service on orgculture.ru (the “Payment for services” page or an invoice link), with the box accepting the Offer ticked before payment. The agreement is concluded when the payment is received (Art. 438 of the Civil Code of the Russian Federation).

1.3. The Contractor may change the Offer by publishing a new version on the site. A new version applies to agreements concluded after its publication; to existing agreements only with the Client’s consent.

1.4. The Contractor applies the special “professional income tax” regime (Federal Law 422-FZ). No VAT is charged.

2. Subject

2.1. The Contractor provides the service chosen at payment — website, bot, auto-posting, analytics system development, or management and promotion (the “Service”) — in the scope of the base package described on the “Payment for services” page and in the commercial offer, or in the scope agreed in correspondence if an invoice for an agreed amount is paid.

2.2. The specific brief (materials, structure, stage deadlines) is agreed in correspondence by email or Telegram within 2 (two) business days after payment. The correspondence forms part of the agreement.

2.3. Work beyond the agreed scope is done under a separate invoice with the Client’s consent.

3. Price and payment

3.1. The price is stated on the “Payment for services” page or in the invoice and is fixed at the moment of payment.

3.2. Payment is 100% upfront via the YooKassa payment service (YooMoney NCO LLC) by bank card, SBP or another available method. Card details are processed by YooKassa and are not passed to the Contractor.

3.3. “Management and promotion” is paid monthly, by a separate payment for each month. There are no automatic charges.

3.4. After payment the Contractor issues a receipt in the “My Tax” app and sends it to the Client by email; the receipt link is also available in the account. If the Client is a sole trader or a company, its name and INN provided at payment are stated in the receipt.

4. Timing and delivery

4.1. The base package is delivered within 1 (one) month after the brief is agreed and the Client provides the necessary materials, unless another period is agreed in correspondence. The period is extended by any delay in the Client’s materials or answers.

4.2. The result is delivered electronically (access, files, links). The Service is deemed provided if the Client sends no reasoned comments within 5 (five) business days after delivery. An acceptance act is issued on request.

4.3. Exclusive rights to the result created for the Client (site, texts, graphics, project-specific code) pass to the Client upon full payment, unless agreed otherwise. The Contractor may mention the project in a portfolio unless the Client objects.

5. Cancellation and refunds

5.1. The Client may cancel the Service at any time before completion by notifying the Contractor by email. The Contractor refunds the payment minus actually incurred expenses and the cost of the part of the Service already provided (Art. 32 of the Russian Consumer Rights Protection Law, Art. 782 of the Civil Code), with a breakdown on request.

5.2. Refunds are made by the original payment method within 10 (ten) days of the request. The receipt for the refunded amount is cancelled in the “My Tax” app.

5.3. Defects of the Service are remedied free of charge within a reasonable time after a justified request. A consumer Client’s rights in case of defects are governed by Art. 29 of the Consumer Rights Protection Law.

6. Liability

6.1. The parties are liable for non-performance or improper performance under Russian law.

6.2. The Contractor is not liable for third-party services chosen by the Client (hosting, domain, social networks, payment systems) or for consequences of their blocking or rule changes not caused by the Contractor.

6.3. The parties are released from liability in case of force majeure (Art. 401 of the Civil Code) for its duration.

7. Personal data

7.1. The Client’s personal data are processed to conclude and perform the agreement under the Privacy Policy published on the site. Consent is given by a separate tick box before payment.

8. Disputes

8.1. Disputes are settled by negotiation. Sending a claim before going to court is a right, not an obligation, of a consumer Client.

8.2. Disputes not settled by negotiation are heard in court under Russian law; a consumer Client may sue at their place of residence (Art. 17 of the Consumer Rights Protection Law).
